AN ORDINANCE OF THE BOROUGH OF NEW BRITAIN, BUCKS COUNTY, PENNSYLVANIA AMENDING THE NEW BRITAIN BOROUGH CODE OF ORDINANCES BY ADDING A NEW CHAPTER, CHAPTER 319 PUBLIC WORKS; CREATING A PUBLIC WORKS DEPARTMENT AND THE POSITION OF DIRECTOR OF PUBLIC WORKS FOR THE BOROUGH OF NEW BRITAIN, AND ESTABLISHING THE DUTIES AND POWERS THEREOF; REPEALING INCONSISTENT ORDINANCES OR PARTS OF ORDINANCES; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

Pursuant to the requirements of the Borough Code, the following is a summary of the ordinance under consideration:

The ordinance adds a new chapter to the Borough’s Code of Ordinances, Chapter 319 Public Works, creating a Department of Public Works in the Borough of New Britain, and setting forth the responsibility and jurisdiction of the department.  The ordinance creates the position of Director of Public Works, to be appointed by Borough Council, and authorizes Borough Council to contract for the position.  The Director of Public Works is to be subject to the control and supervision of Borough Council or its designee.  The ordinance sets forth the duties of the Director of Public Works, which include such subject matter as the streets of the Borough, the storm sewers of the Borough, and the maintenance of Borough real property.  The ordinance also allows Borough Council to assign additional duties from time-to-time.  The ordinance requires the Director to develop a budget for the Department, in consultation with appropriate Borough Committees and staff, for the consideration of Borough Council, and further requires that the Director investigate all sources of funding that might be available for Department operations.  The ordinance contains a severability clause, repeals prior inconsistent ordinances or parts of ordinances, and contains an effective date.
